The cd has a paper sticker on it (is from ADS Tech!!!). I have tried the terminal, Toast, rebooting with left side of trackpad down, the works...
I read that a guy had inserted a flat head screwdriver tip in the cd slot and managed to 'catch' the cd. If I knew the internal 'design' of the cd-rom slot, I might try it.
Any suggestions?

To remove he disk without destroying it or the drive, your best bet is to open the machine and open the disk drive.
