My ipod is not allowing me to get to the menu.
If the battery is not fully charged, it will stop my menu from appearing.

Have you tried restoring it? Or restarting it?

Could you update your question to be a little more clear? Can you still listen to music? What happens when you plug your iPod into your computer? Does the backlight come on at all?
