You really need to get your system to Apple. I promise you Apple will exchange out under warranty '''Free !''' the HD if it's defective (which from your symptoms it sure sounds like it is).

Please don't try opening it up as you don't want to give Apple a reason why they should refuse to repair this under warranty.
